§ 1 Scope of Application

These General Terms and Conditions (hereinafter "Terms") apply to all contracts between Librion OÜ, Viru väljak 2, 10111 Tallinn, Estonia, registration number 17036485 (hereinafter the "Provider" or "Librion"), and the customer regarding the provision of educational services, in particular exam preparation courses for the specialist language examination (FaMed), language training, simulation exams, and accommodation packages.

The services are provided exclusively at the Bodrum, Turkey location. The conclusion and performance of the contract take place in Turkey.

These Terms are addressed exclusively to customers residing outside the European Union. The provisions of European consumer law, in particular the right of withdrawal for distance contracts under the EU Consumer Rights Directive, do not apply.

Deviating, conflicting, or supplementary general terms and conditions of the customer shall only become part of the contract if the Provider has expressly agreed to their validity in writing.

§ 2 Conclusion of Contract

The presentation of services on the Provider's website does not constitute a legally binding offer, but rather an invitation for the customer to submit an offer.

By booking through the online booking form or via email, the customer submits a binding offer to conclude a service contract.

The contract is concluded when the Provider accepts the customer's offer through an explicit acceptance statement by email (booking confirmation) or accepts it implicitly by providing the service.

By booking, the customer confirms having read, understood, and accepted these Terms.

§ 3 Description of Services

The Provider offers educational services in the field of exam preparation, in particular:

  • FaMed specialist language preparation courses
  • Medical communication training
  • Simulation exams under realistic conditions
  • Individual support and feedback
  • Optional: accommodation and transfer services

The exact scope of services results from the respective service description of the booked package and the booking confirmation.

The Provider reserves the right to adapt the content and structure of the courses for didactic or organizational reasons, provided this does not materially change the essential character of the service.

§ 4 Prices and Payment Terms

The prices stated on the website at the time of booking apply. All prices are in Euro (EUR) and are final prices.

The total amount is due immediately upon booking. Payment is made by bank transfer or via the online payment service provided by the Provider (Stripe).

In the case of payment via Stripe, the amount is first authorized (reserved); the actual charge is made after confirmation by the Provider.

§ 5 Cancellation and Rebooking

There is no statutory right of withdrawal under EU consumer law, as the services are provided exclusively in Turkey and are not directed at consumers residing in the European Union.

Within the first 14 days after booking, the booking can be cancelled free of charge, provided more than 21 days remain until the exam date. The cancellation request must be submitted in writing by email to info@librionbodrum.com.

After the 14-day period under the previous paragraph has expired, but more than 21 days before the exam date, a rebooking to another available date is possible for a fee of 25% of the booking price. The rebooking request must be submitted in writing by email to info@librionbodrum.com. Rebooking is subject to availability of open spots on the desired alternative date.

If less than 21 days remain until the exam date, neither cancellation nor rebooking is possible. Participation is bound to the booked date.

In the event of the customer's tardiness or non-appearance at the booked date, the entitlement to the service lapses without compensation. A refund or rebooking is excluded in this case. The customer must book a new date.

Participation in the course is voluntary. By booking, the customer declares that they have noted and accepted the conditions of this section.

To participate in the exam in Bodrum, the customer is obligated to present a valid photo ID (identity card or passport) as well as the original of their B2 language certificate on the day of the exam. Without these documents, participation in the exam is not possible under any circumstances.

Librion assumes no liability for the consequences of non-compliance with this documentation requirement. If the ID or B2 certificate is missing, the entitlement to exam participation lapses without compensation. A refund or rebooking is excluded in this case.

§ 6 Course Changes and Minimum Number of Participants

The Provider reserves the right to cancel or postpone course dates if a minimum of 3 participants is not reached. In this case, the customer will be informed at least 14 days before the planned course start.

In the event of cancellation by the Provider under the previous paragraph, the customer will receive a full refund of payments already made or may rebook free of charge to an alternative course date.

The Provider is entitled to change the course instructor for good cause (e.g., illness of the instructor), provided this does not materially impair the success of the course.

§ 7 Limitation of Liability

The Provider is liable without limitation for damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty by the Provider or its agents.

For other damages, the Provider is only liable in cases of intent or gross negligence, as well as culpable breach of material contractual obligations. In the case of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract.

Liability for indirect damages, consequential damages, and lost profits is excluded to the extent permitted by law.

The Provider is not liable for the loss of or damage to the customer's personal belongings during the course, unless the loss or damage is due to intent or gross negligence on the part of the Provider.

§ 8 No Guarantee of Success

The Provider provides educational services to prepare for the specialist language examination (FaMed). No guarantee is given for passing the exam.

Exam success depends on numerous factors, including individual preparation, language proficiency, and the customer's personal performance on the day of the exam. The Provider assumes no liability for failing the exam.

Librion is not an exam provider and has no connection to the examining authorities. The exams are conducted by the responsible German state medical boards (Landesärztekammern) or commissioned examination institutes.

§ 9 Force Majeure

Events of force majeure that significantly hinder or make the provision of services impossible entitle the Provider to postpone the service for the duration of the impediment plus a reasonable start-up period, or to withdraw from the contract.

Force majeure includes, in particular, natural disasters, epidemics, pandemics, war, terrorism, unrest, official orders, strikes, or other unforeseeable events beyond the Provider's control.

In the event of withdrawal due to force majeure, payments already made will be refunded less costs already incurred. Further claims for damages are excluded.

§ 10 Data Protection

The Provider processes the customer's personal data in accordance with applicable data protection regulations, in particular the EU General Data Protection Regulation (GDPR), where applicable.

§ 11 Applicable Law and Jurisdiction

The law of the Republic of Turkey applies to all legal relationships between the Provider and the customer, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is Bodrum, Turkey, provided the customer is a merchant, a legal entity under public law, or a special fund under public law, or has no general place of jurisdiction in Turkey.

The application of European consumer law is excluded, as the services are provided exclusively in Turkey and are not directed at consumers residing in the European Union.

§ 12 Severability Clause

Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

In place of the invalid or unenforceable provision, the valid and enforceable provision that comes closest to the economic purpose of the invalid or unenforceable provision shall be deemed agreed.

§ 13 Language Version

These Terms are drafted in German. Translations into other languages are for informational purposes only.

In the event of discrepancies between the German version and a translation, the German version shall prevail.

§ 14 Amendments to these Terms

The Provider reserves the right to amend these Terms at any time with effect for the future.

For contracts already concluded, the Terms in force at the time of conclusion of the contract shall apply.
